ARTICLE 2 - SCOPE AND ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

The Customer designates any natural or legal person using the Site www.cmdvcollection.com and placing with CMDV an order for validated Product(s) (hereinafter "the Products").

(hereinafter referred to as the "Site") in the "Terms & Conditions" section.
Any order implies, on the part of the Customer, the acceptance of these General Conditions of Sale.
In addition, with each purchase of product(s) on the Site, the Customer will be asked to read and approve the General Conditions of Sale applicable on the date of placing the order.
To justify this acceptance, the Customer acknowledges having read and approved the present General Terms and Conditions of Sale.
CMDV is entitled to make any changes it deems useful.
If the Customer does not agree with any part of these General Conditions of Sale, the Customer
cannot access the orders.
ARTICLE 3 - ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
These General Conditions of Sale are expressly approved and accepted by the Customer, who
declares and acknowledges having perfect knowledge of them, and therefore waives the right to rely
on any contradictory document and, in particular, his own general conditions of sale. purchase, which
will be unenforceable against CMDV, even if it is aware of it.
If any of the provisions of these General Terms and Conditions of Sale were cancelled, this nullity
would not entail the nullity of the other provisions of the said General Terms and Conditions of Sale,

ARTICLE 4 - PRODUCT INFORMATION
CMDV presents on its Website www.cmdvcollection.com Products for sale with the necessary
characteristics to comply with Article L 111-1 of the Consumer Code, which provides the possibility for
the potential customer to read them before the final order taking of the essential characteristics of the
Products that he wishes to buy. It is up to the Customer to check with the local authorities of his
country the possibilities of importing or using the Products ordered. The offers presented by CMDV
are only valid within the limit of available parts.
ARTICLE 5 - CONCLUSION OF THE CONTRACT
The subject of the contract is the online sale of second-hand Products from fashion designers.
By offering our selection of Products on the Site www.cmdvcollection.com, we provide the Customer
with a binding offer to conclude a contract of sale subject to the conditions specified in the description
of the article.
ARTICLE 6 - PURCHASE AGREEMENT
The Customer who wishes to place an order must respect the following procedure:

Log in to his/her mailbox
Send a purchase request by e-mail to info@cmdvcollection.com, specifying the product name
The customer will receive an e-mail with the present General Terms and Conditions of sale attached, the request of his personal details and a payment link
Fill in his/her personal details (mandatory information: name, email, address, country, city, zip code, telephone number, billing address) and return them by email
Click on the payment link in the email to proceed to payment
With the Paypal payment link: Enter the exact amount of the product price and click on “send” to confirm payment
With the Stripe payment link: Enter your credit card numbers and click on “pay”
Confirm payment after checking the order, total price, delivery and billing address
Once the Customer has confirmed his/her order, read and accepted the General Terms and Conditions of Sale and validated payment, the order will be processed in accordance with these General Terms and Conditions of Sale.
Order acknowledgment
The execution of the order and the sending of all the details necessary for the conclusion of the
contract are carried out by email, in a partially automated way.
Therefore, the Customer must ensure that the email address provided is the correct one and that the
receipt of receptive emails is guaranteed.
The Customer will receive an email with an electronic invoice as confirmation and conclusion of the
contract.
In the event of difficulty in accessing his order, the Customer will contact support by email at the

Order shipping confirmation
When the order is shipped, the Customer will receive a shipping confirmation email with a tracking
number.
In the event of unavailability after placing the order, CMDV will inform the Customer as soon as
possible by email.
The order will then be automatically canceled and the Customer refunded at the latest within fifteen
(15) days of notification of the cancellation.
The registration of an order is made when the Customer accepts these General Conditions of Sale
and validates his order.
The Customer has the possibility to check the details of his order, its total price and to correct any
errors before confirming his acceptance (article 1127-2 of the Civil Code).
It is therefore up to the Customer to verify the accuracy of the order and to immediately report any
errors.
CMDV reserves the right to cancel or refuse any order from a Customer with whom there is a dispute
relating to the payment of a previous order or if CMDV reasonably considers that this Customer has
breached these General Conditions of Sale and is engaged in fraudulent activity, or for any other
legitimate reason.
Order Tracking
A carrier tracking number is provided to the Customer in the order shipping confirmation email.
If the Customer wishes to obtain information on the progress of his order, he can connect to the site of
the carrier chosen by CMDV and follow the delivery of his package live.
ARTICLE 7 - RESPONSIBILITY
The Products offered comply with the French legislation in force.
CMDV cannot be held liable in the event of non-compliance with the legislation of the country where
the Product is delivered.
It is up to the Customer to check with the local authorities the possibilities of importing or using the
Products or services that he plans to order.
In addition, CMDV cannot be held liable for damages resulting from improper use of the purchased
Product.
Finally, CMDV cannot be held responsible for any inconvenience or damage inherent in the use of the
Internet network, in particular a break in service, an external intrusion or the presence of computer
viruses.
ARTICLE 8 - PRODUCTS
The Products offered on the Site www.cmdvcollection.com are second-hand clothes and accessories
from fashion designers.
All Products are carefully selected and are in good condition.
However, it is possible that slight signs of wear may appear on some of the Products presented on
the Site.
The Customer should refer to the product photos on each product sheet.
ARTICLES 9 - SIZE & MEASUREMENT
Identifying the right size is essential for a satisfactory purchase.
The measurements of the Products are detailed and indicated in each of the product sheets on the
Site.
However, CMDV will respond attentively and provide additional and in-depth information via
info@cmdvcollection.com if requested by the Customer to ensure that purchases correspond to
potential buyers.
ARTICLE 10 - AVAILABILITY
Each Product is a unique piece presented in a single copy.
In case of unavailability of a Product during an order, it will be canceled by CMDV via
www.cmdvcollection.com.
The Customer will be informed as soon as possible by email and will be refunded immediately.
CMDV declines all responsibility in the event of unavailability of Products for orders not yet accepted
by CMDV.
CMDV cannot and does not guarantee the accuracy or completeness of any information, including
prices, specifications, availability and services.
CMDV reserves the right to modify or update information and to correct errors, inaccuracies or
omissions at any time without notice.
CMDV cannot be held responsible in the event that technical limitations of color reproduction on the
Customer's computer equipment cause variations in the colors of the photographs and/or graphic
representations of the Products appearing on the Site.
ARTICLE 11 - LEGAL GUARANTEES
In accordance with Article 4 of Decree No. 78-464 of March 24, 1978, the provisions hereof cannot
deprive the buyer of the legal guarantee which obliges the professional seller to guarantee him
against all the consequences of hidden defects of the product sold.
The Products sold by CMDV are subject to the conditions of legal guarantees provided for by articles
L.217-4 to L.217-14 of the Consumer Code as well as by articles 1641 to 1648 of the Civil Code, to the exclusion of any other warranties.
CMDV will refuse any claim for Products that have been used contrary to their intended purpose.
Legal guarantee of conformity
CMDV delivers to the Customer a Product that complies with the contract and is free from defects of
conformity when the said Product is delivered. The Products sold by CMDV are specific to the use
normally expected of a similar good. CMDV is also liable for any lack of conformity resulting from the
packaging, subject to contractual liability or the processes implemented under its responsibility.
Legal guarantee against latent defects
CMDV will deliver to the Customer a Product free from latent defects which would make it unsuitable for the use for which it is intended, or which substantially reduce this use, that he would not have
acquired it or would have paid a price lower if he had known about it.
These guarantees apply provided that the Customer makes the request within 24 months following
the delivery of the Product (for the legal guarantee of conformity) or the discovery of the defect (for
the legal guarantee of hidden defects). Conformity defects appearing within 24 months of delivery are
presumed to exist at the time of delivery, unless proven otherwise.
In the event of proven non-compliance on a Product sold by CMDV, the Customer may choose
between repairing or replacing the Product unless one of these choices is commercially unreasonable
for CMDV.
If the repair or replacement of the Product is impossible, the Customer may be reimbursed and must
return the Product or keep the Product and be reimbursed part of the price, unless the lack of
conformity is minor. In the event of a real hidden defect on a Product sold by CMDV, the Customer
will have the choice of returning the Product and being reimbursed the price and costs incurred by the
sale or keeping the Product and being reimbursed part of the price.
In any case, it will be up to the Customer to prove that he correctly fulfills the conditions of the
guarantee. The return, replacement or refund of the Product will be made at no cost to the Customer
and will not prevent any damage that may arise. In the event of a lack of conformity and/or hidden
defects recognized by CMDV, if the Customer chooses to return the Product, he will send it to the

ARTICLE 12 - PRICE AND INVOICING
The prices indicated on the Site are in euros excluding tax (VAT not applicable, art. 293B of the
General Tax Code).
All orders must be paid in euros. CMDV reserves the right to modify its prices at any time.
In the event of late payment, there will be application of a lump sum compensation for recovery costs
of €40 according to article D441-5 of the Commercial Code.
The validity of the prices will always be that which will be indicated on the Site
www.cmdvcollection.com at the time of placing the order.
The Customer pays his order directly via the PayPal or Stripe secure online payment service system,
whose bank details (payment card number and expiry date) of the Customer cannot be intercepted by
a third party. Under no circumstances does CMDV record data relating to the Customer's bank card.
Payment is due immediately on the date of the order.
An electronic invoice is established by CMDV and delivered by email to the Customer upon receipt of
payment for the Product(s) ordered. The electronic invoice summarizes the total of the orders.
The Customer accepts the electronic invoice received by email as a form of delivery thereof.
The Customer may revoke this method of invoicing by notifying it to: info@cmdvcollection.com.
CMDV reserves the right, in the event of non-compliance with the payment conditions listed above, to
suspend or cancel an order.
ARTICLE 13 - PRICE REVISION
The prices of the Products offered may be subject to revision by CMDV at any time, at its sole
discretion.
ARTICLE 14 - METHOD OF PAYMENT
To pay for his order, the Customer has different payment methods:

These methods are safe and reliable for paying online.
Payments made on the www.cmdvcollection.com Site are encrypted and secure and no banking
information concerning the Customer is transmitted via the www.cmdvcollection.com Site.
The debit of the Customer's order is made upon validation of the order, provided that the authorization
to debit his account has been previously received from the competent payment centers, failing which

ARTICLE 15 - DELIVERY CONDITIONS
The Products are delivered worldwide and the delivery costs are included in the price of the Product.
Delivery time
France - three to seven working days
Europe - seven to thirty business days
Rest of the world - ten to thirty working days
Via DHL or French Post.
Deliveries are not made on Sundays and other public holidays.
Unfortunately shipping to the UK is not possible due to Brexit at this time.
CMDV will in no way be held responsible in the event of a delay in the delivery time.
In addition, CMDV cannot be held responsible for any action and/or costs and/or taxes (which are the
Customer's responsibility) and/or delay due to customs over which it has no control.
The Customer will be able to follow his parcel from his departure until his arrival with a tracking
number, sent by e-mail during the confirmation of dispatch of the order.
It is the Customer's responsibility to check the condition and contents of the package at the time of
delivery and before signing the carrier's delivery note. The Customer must indicate on this delivery
note and in the form of reservations deemed to have been made when the Customer, or a person of
his choice, has signed the delivery note. No complaint concerning the condition of the package(s) will
be admissible thereafter. In the event of reservations about the delivery, the Customer must also
confirm them to the carrier no later than 3 working days following receipt of the item(s) and send a
copy of this letter to CMDV by email at info@cmdvcollection.com, with supporting photos.
The Products are delivered to the address indicated by the Customer when registering the order.
In the event of an incomplete address, incorrect address, impossibility of depositing the package in
the Customer's mailbox, refusal of the package by the recipient, lack of information making it
impossible to deliver the Product to the recipient within given deadlines, CMDV cannot be responsible
for the complete and definitive execution of this delivery. If this lack of information leads to a second
presentation to the recipient, CMDV will be entitled to ask the Customer to pay the costs
corresponding to this second delivery.
The Customer is subject to the carrier's general delivery conditions which, in certain cases, if he does
not comply with them may impact the quality of the delivery. Thus, in the event of the recipient's
absence, according to the carrier's general delivery conditions, the Product may be presented again
and/or dropped off at an agreed pick-up point and/or in front of the Customer's home and/or in a
“sorting – waiting” by the carrier and/or returned to CMDV, which cannot under any circumstances be
held responsible for any theft, loss or deterioration of the Products on the occasion of their delivery
and, more generally, for the quality of the delivery. In case of impossibility of delivery and if the
Product must be returned to CMDV by the carrier, CMDV will not make any new delivery at its
expense. Any complaint concerning the delivery of the Products must be made within 14 workin days of receipt of the Product(s) by e-mail to info@cmdvcollection.com. If it is decided that the
Product(s) should be returned to CMDV, they must be returned in their original condition (packaging,
accessories, etc.). The Product must be returned with a tracking number to CMDV – 11, Rue du
Levant, 92380 Garches, France.
ARTICLE 16 - RIGHT OF WITHDRAWAL, RETURN AND REFUND
In accordance with the provisions of Article L.121-21 of the Consumer Code, the Customer has a
withdrawal period of 14 days from receipt of the Products and he has the right to be reimbursed for
the full price within a period of 14 days maximum without need to justify or be penalized.
If the Customer is not satisfied with the product purchased, he may return the Product, in its original
condition and packaging, within a maximum period of 14 days from the date of receipt of the order,
accompanied by a copy of the invoice, to the following address: CMDV - 11 rue du Levant - 92380

Shipping and return costs are the responsibility of the Customer.
Damaged items will not be refunded and will be returned to the Customer as is, at their expense.
CMDV reserves the right to refuse reimbursement until the Product(s) have been returned or until the
Customer has provided proof that he has sent the( s) Product(s), whichever comes first.
When a refund is issued, a confirmation email is sent to the Customer.

Parcels for which the identification of the Customer (surname, first name, address) is not possible are
refused.
All returns must be made by a traceable method and the tracking number must be provided to CMDV.
ARTICLE 17 - REFUND POLICY
Once the period of the right of withdrawal has passed, CMDV no longer offers refunds.
ARTICLE 18 - COPYRIGHT AND INTELLECTUAL PROPERTY
The elements contained on the Site www.cmdvcollection.com, namely: documents, information, images, photographs, graphics, texts, visuals, creative content or any other content published on the
Site www.cmdvcollection.com are the property of CMDV and are protected by French and
international laws relating to Intellectual Property.

All other non-CMDV trademarks, logos or slogans that appear on this site are the property of their
respective owners, who are not affiliated, connected or sponsored by CMDV.
Without prior authorization and in the event of use by a third party, sanctions may be applicable under

ARTICLE 19 - PROTECTION OF PERSONAL DATA
CMDV respects the privacy of its Clients.
Private information is used exclusively by CMDV and will never be disclosed to third parties, only to
external service providers such as delivery services, in order to guarantee the correct receipt of the
order as well as a quality of service to the Customer.
CMDV uses this information to process orders and to inform Customers of new products, events and
possible updates.
In accordance with the law of January 6, 1978, the Customer has a right of access, rectification and
opposition to personal information and personal data concerning him, by contacting via

ARTICLE 21 - FORCE MAJEURE
Any unavoidable external circumstances that are unforeseeable and beyond the reasonable control
suffered by one of the parties are considered as force majeure.
In the event that CMDV encounters a case of force majeure, CMDV undertakes to inform the
Customer within 96 hours, specifying the exact elements constituting the force majeure, the
reasonably foreseeable period of delay or impediment.
CMDV will then be exonerated from any liability due to the non-execution or the delay in the execution
of its obligations. In such a case of force majeure, CMDV may exercise its discretionary right to
terminate the order or part of it, without its liability being incurred, except however that CMDV will be
responsible for reimbursing the Customer for sums already paid.
ARTICLE 22 - MODIFICATION
CMDV reserves the right to modify these General Conditions of Sale at any time.
The Customer will be informed of these modifications by any useful means 30 days before their entry
into force.
The Customer who does not accept the modified General Conditions of Sale must not use the Site
and access the Product offers to place an order.
Any Customer who uses the Product offers after the entry into force of the modified General
Conditions is deemed to have accepted these modifications.
ARTICLE 23 - DISPUTE - ATTRIBUTION OF JURISDICTION - APPLICABLE LAW
These General Terms and Conditions of Sale and the resulting transactions are governed by and
subject to French law.
The language of this contract is French, translated into English for international users.
These conditions of sale are subject to French law. In the event of a dispute, the French courts will
have sole jurisdiction. In the event of a dispute over the validity, interpretation and/or execution of

In accordance with ordinance n°2015-1033 of August 20, 2015 and implementing decree n°2015-1382 of October 30, 2015, any dispute or consumer dispute subject to article L.612-2 of the
Code of consumption, can be settled amicably.
In accordance with Articles L.616-1 and R.616-1 of the Consumer Code, CMDV has set up a
consumer mediation system.
The chosen mediation entity is: CMAP - Center for Mediation and Arbitration of Paris.
In the event of a dispute, the Customer may file their complaint on the CMAP website: www.cmap.fr in
the tab "you are: a consumer" or by post by writing to: CMAP - Médiation Consumption, 39 avenue
Franklin D. Roosevelt, 75008 Paris, France.
The Customer's request must contain his postal address, his e-mail address and his telephone
number as well as the surname, first name and address of CMDV, a clear statement of the facts and
proof of the previous steps taken with CMDV, so that this request is processed quickly.
All disputes relating to the content, interpretation, validity or execution of these General Conditions of
Sale and which cannot be settled amicably will be the exclusive jurisdiction of the courts of the city of
the registered office. of CMDV, regardless of the Customer's head office or residence.
ARTICLE 24 - LANGUAGE OF THE CONTRACT AND TRANSLATION
The language of the contract is French.
These General Conditions of Sale have been translated from French to English. The Customer
agrees that the original text in French shall prevail in the event of a dispute.

ARTICLE 4 - PRODUCT INFORMATION
CMDV presents on its Website www.cmdvcollection.com Products for sale with the necessary characteristics to comply with Article L 111-1 of the Consumer Code, which provides the possibility for the potential customer to read them before the final order taking of the essential characteristics of the Products that he wishes to buy. It is up to the Customer to check with the local authorities of his country the possibilities of importing or using the Products ordered. The offers presented by CMDV are only valid within the limit of available parts.
ARTICLE 5 - CONCLUSION OF THE CONTRACT
The subject of the contract is the online sale of second-hand Products from fashion designers.
By offering our selection of Products on the Site www.cmdvcollection.com, we provide the Customer with a binding offer to conclude a contract of sale subject to the conditions specified in the description of the article.
ARTICLE 6 - PURCHASE AGREEMENT
The Customer who wishes to place an order must respect the following procedure:

Log in to his/her mailbox
Send a purchase request by e-mail to info@cmdvcollection.com, specifying the product name
The customer will receive an e-mail with the present General Terms and Conditions of sale attached, the request of his personal details and a payment link
Fill in his/her personal details (mandatory information: name, email, address, country, city, zip code, telephone number, billing address) and return them by email
Click on the payment link in the email to proceed to payment
With the Paypal payment link: Enter the exact amount of the product price and click on “send” to confirm payment
With the Stripe payment link: Enter your credit card numbers and click on “pay”
Confirm payment after checking the order, total price, delivery and billing address
Once the Customer has confirmed his/her order, read and accepted the General Terms and Conditions of Sale and validated payment, the order will be processed in accordance with these General Terms and Conditions of Sale.
Order acknowledgment
The execution of the order and the sending of all the details necessary for the conclusion of the contract are carried out by email, in a partially automated way.
Therefore, the Customer must ensure that the email address provided is the correct one and that the receipt of receptive emails is guaranteed.
The Customer will receive an email with an electronic invoice as confirmation and conclusion of the contract.
In the event of difficulty in accessing his order, the Customer will contact support by email at the following address: info@cmdvcollection.com.
Order shipping confirmation
When the order is shipped, the Customer will receive a shipping confirmation email with a tracking number.
In the event of unavailability after placing the order, CMDV will inform the Customer as soon as possible by email.
The order will then be automatically canceled and the Customer refunded at the latest within fifteen (15) days of notification of the cancellation.
The registration of an order is made when the Customer accepts these General Conditions of Sale and validates his order.
The Customer has the possibility to check the details of his order, its total price and to correct any errors before confirming his acceptance (article 1127-2 of the Civil Code).
It is therefore up to the Customer to verify the accuracy of the order and to immediately report any errors.
CMDV reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order or if CMDV reasonably considers that this Customer has breached these General Conditions of Sale and is engaged in fraudulent activity, or for any other legitimate reason.
Order Tracking
A carrier tracking number is provided to the Customer in the order shipping confirmation email.
If the Customer wishes to obtain information on the progress of his order, he can connect to the site of the carrier chosen by CMDV and follow the delivery of his package live.
ARTICLE 7 - RESPONSIBILITY
The Products offered comply with the French legislation in force.
CMDV cannot be held liable in the event of non-compliance with the legislation of the country where the Product is delivered.
It is up to the Customer to check with the local authorities the possibilities of importing or using the Products or services that he plans to order.
In addition, CMDV cannot be held liable for damages resulting from improper use of the purchased Product.
Finally, CMDV cannot be held responsible for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses.
ARTICLE 8 - PRODUCTS
The Products offered on the Site www.cmdvcollection.com are second-hand clothes and accessories from fashion designers.
All Products are carefully selected and are in good condition.
However, it is possible that slight signs of wear may appear on some of the Products presented on the Site.
The Customer should refer to the product photos on each product sheet.
ARTICLES 9 - SIZE & MEASUREMENT
Identifying the right size is essential for a satisfactory purchase.
The measurements of the Products are detailed and indicated in each of the product sheets on the Site.
However, CMDV will respond attentively and provide additional and in-depth information via info@cmdvcollection.com if requested by the Customer to ensure that purchases correspond to potential buyers.
ARTICLE 10 - AVAILABILITY
Each Product is a unique piece presented in a single copy.
In case of unavailability of a Product during an order, it will be canceled by CMDV via www.cmdvcollection.com.
The Customer will be informed as soon as possible by email and will be refunded immediately.
CMDV declines all responsibility in the event of unavailability of Products for orders not yet accepted by CMDV.
CMDV cannot and does not guarantee the accuracy or completeness of any information, including prices, specifications, availability and services.
CMDV reserves the right to modify or update information and to correct errors, inaccuracies or omissions at any time without notice.
CMDV cannot be held responsible in the event that technical limitations of color reproduction on the Customer's computer equipment cause variations in the colors of the photographs and/or graphic representations of the Products appearing on the Site.
ARTICLE 11 - LEGAL GUARANTEES
In accordance with Article 4 of Decree No. 78-464 of March 24, 1978, the provisions hereof cannot deprive the buyer of the legal guarantee which obliges the professional seller to guarantee him against all the consequences of hidden defects of the product sold.
The Products sold by CMDV are subject to the conditions of legal guarantees provided for by articles L.217-4 to L.217-14 of the Consumer Code as well as by articles 1641 to 1648 of the Civil Code, to the exclusion of any other warranties.
CMDV will refuse any claim for Products that have been used contrary to their intended purpose.
Legal guarantee of conformity
CMDV delivers to the Customer a Product that complies with the contract and is free from defects of conformity when the said Product is delivered. The Products sold by CMDV are specific to the use normally expected of a similar good. CMDV is also liable for any lack of conformity resulting from the packaging, subject to contractual liability or the processes implemented under its responsibility.
Legal guarantee against latent defects
CMDV will deliver to the Customer a Product free from latent defects which would make it unsuitable for the use for which it is intended, or which substantially reduce this use, that he would not have acquired it or would have paid a price lower if he had known about it.
These guarantees apply provided that the Customer makes the request within 24 months following the delivery of the Product (for the legal guarantee of conformity) or the discovery of the defect (for the legal guarantee of hidden defects). Conformity defects appearing within 24 months of delivery are presumed to exist at the time of delivery, unless proven otherwise.
In the event of proven non-compliance on a Product sold by CMDV, the Customer may choose between repairing or replacing the Product unless one of these choices is commercially unreasonable for CMDV.
If the repair or replacement of the Product is impossible, the Customer may be reimbursed and must return the Product or keep the Product and be reimbursed part of the price, unless the lack of conformity is minor. In the event of a real hidden defect on a Product sold by CMDV, the Customer will have the choice of returning the Product and being reimbursed the price and costs incurred by the sale or keeping the Product and being reimbursed part of the price.
In any case, it will be up to the Customer to prove that he correctly fulfills the conditions of the guarantee. The return, replacement or refund of the Product will be made at no cost to the Customer and will not prevent any damage that may arise. In the event of a lack of conformity and/or hidden defects recognized by CMDV, if the Customer chooses to return the Product, he will send it to the following address:

ARTICLE 12 - PRICE AND INVOICING
The prices indicated on the Site are in euros excluding tax (VAT not applicable, art. 293B of the General Tax Code).
All orders must be paid in euros. CMDV reserves the right to modify its prices at any time.
In the event of late payment, there will be application of a lump sum compensation for recovery costs of €40 according to article D441-5 of the Commercial Code.
The validity of the prices will always be that which will be indicated on the Site www.cmdvcollection.com at the time of placing the order.
The Customer pays his order directly via the PayPal or Stripe secure online payment service system, whose bank details (payment card number and expiry date) of the Customer cannot be intercepted by a third party. Under no circumstances does CMDV record data relating to the Customer's bank card.
Payment is due immediately on the date of the order.
An electronic invoice is established by CMDV and delivered by email to the Customer upon receipt of payment for the Product(s) ordered. The electronic invoice summarizes the total of the orders.
The Customer accepts the electronic invoice received by email as a form of delivery thereof.
The Customer may revoke this method of invoicing by notifying it to: info@cmdvcollection.com.
CMDV reserves the right, in the event of non-compliance with the payment conditions listed above, to suspend or cancel an order.
ARTICLE 13 - PRICE REVISION
The prices of the Products offered may be subject to revision by CMDV at any time, at its sole discretion.
ARTICLE 14 - METHOD OF PAYMENT
To pay for his order, the Customer has different payment methods:

These methods are safe and reliable for paying online.
Payments made on the www.cmdvcollection.com Site are encrypted and secure and no banking information concerning the Customer is transmitted via the www.cmdvcollection.com Site.
The debit of the Customer's order is made upon validation of the order, provided that the authorization to debit his account has been previously received from the competent payment centers, failing which his order cannot be taken into account.
ARTICLE 15 - DELIVERY CONDITIONS
The Products are delivered worldwide and the delivery costs are included in the price of the Product.
Delivery time
France - three to seven working days
Europe - seven to thirty business days
Rest of the world - ten to thirty working days Via DHL or French Post.
Deliveries are not made on Sundays and other public holidays.
Unfortunately shipping to the UK is not possible due to Brexit at this time.
CMDV will in no way be held responsible in the event of a delay in the delivery time.
In addition, CMDV cannot be held responsible for any action and/or costs and/or taxes (which are the Customer's responsibility) and/or delay due to customs over which it has no control.
The Customer will be able to follow his parcel from his departure until his arrival with a tracking number, sent by e-mail during the confirmation of dispatch of the order.
It is the Customer's responsibility to check the condition and contents of the package at the time of delivery and before signing the carrier's delivery note. The Customer must indicate on this delivery note and in the form of reservations deemed to have been made when the Customer, or a person of his choice, has signed the delivery note. No complaint concerning the condition of the package(s) will be admissible thereafter. In the event of reservations about the delivery, the Customer must also confirm them to the carrier no later than 3 working days following receipt of the item(s) and send a copy of this letter to CMDV by email at info@cmdvcollection.com, with supporting photos.
The Products are delivered to the address indicated by the Customer when registering the order.
In the event of an incomplete address, incorrect address, impossibility of depositing the package in the Customer's mailbox, refusal of the package by the recipient, lack of information making it impossible to deliver the Product to the recipient within given deadlines, CMDV cannot be responsible for the complete and definitive execution of this delivery. If this lack of information leads to a second presentation to the recipient, CMDV will be entitled to ask the Customer to pay the costs corresponding to this second delivery.
The Customer is subject to the carrier's general delivery conditions which, in certain cases, if he does not comply with them may impact the quality of the delivery. Thus, in the event of the recipient's absence, according to the carrier's general delivery conditions, the Product may be presented again and/or dropped off at an agreed pick-up point and/or in front of the Customer's home and/or in a “sorting – waiting” by the carrier and/or returned to CMDV, which cannot under any circumstances be held responsible for any theft, loss or deterioration of the Products on the occasion of their delivery and, more generally, for the quality of the delivery. In case of impossibility of delivery and if the Product must be returned to CMDV by the carrier, CMDV will not make any new delivery at its expense. Any complaint concerning the delivery of the Products must be made within 14 workin days of receipt of the Product(s) by e-mail to info@cmdvcollection.com. If it is decided that the Product(s) should be returned to CMDV, they must be returned in their original condition (packaging, accessories, etc.). The Product must be returned with a tracking number to CMDV – 11, Rue du Levant, 92380 Garches, France.
ARTICLE 16 - RIGHT OF WITHDRAWAL, RETURN AND REFUND
In accordance with the provisions of Article L.121-21 of the Consumer Code, the Customer has a withdrawal period of 14 days from receipt of the Products and he has the right to be reimbursed for the full price within a period of 14 days maximum without need to justify or be penalized.
If the Customer is not satisfied with the product purchased, he may return the Product, in its original condition and packaging, within a maximum period of 14 days from the date of receipt of the order, accompanied by a copy of the invoice, to the following address: CMDV - 11 rue du Levant - 92380 Garches - France.
Shipping and return costs are the responsibility of the Customer.
Damaged items will not be refunded and will be returned to the Customer as is, at their expense.
CMDV reserves the right to refuse reimbursement until the Product(s) have been returned or until the Customer has provided proof that he has sent the( s) Product(s), whichever comes first.
When a refund is issued, a confirmation email is sent to the Customer.

CMDV cannot be held responsible in the event of loss, theft or damage to the package.
Parcels for which the identification of the Customer (surname, first name, address) is not possible are refused.
All returns must be made by a traceable method and the tracking number must be provided to CMDV.
ARTICLE 17 - REFUND POLICY
Once the period of the right of withdrawal has passed, CMDV no longer offers refunds.
ARTICLE 18 - COPYRIGHT AND INTELLECTUAL PROPERTY
The elements contained on the Site www.cmdvcollection.com, namely: documents, information, images, photographs, graphics, texts, visuals, creative content or any other content published on the Site www.cmdvcollection.com are the property of CMDV and are protected by French and international laws relating to Intellectual Property.
These contents may not be reproduced or transformed without the prior and explicit authorization of CMDV.
All other non-CMDV trademarks, logos or slogans that appear on this site are the property of their respective owners, who are not affiliated, connected or sponsored by CMDV.

ARTICLE 19 - PROTECTION OF PERSONAL DATA
CMDV respects the privacy of its Clients.
Private information is used exclusively by CMDV and will never be disclosed to third parties, only to external service providers such as delivery services, in order to guarantee the correct receipt of the order as well as a quality of service to the Customer.
CMDV uses this information to process orders and to inform Customers of new products, events and possible updates.

ARTICLE 21 - FORCE MAJEURE
Any unavoidable external circumstances that are unforeseeable and beyond the reasonable control suffered by one of the parties are considered as force majeure.
In the event that CMDV encounters a case of force majeure, CMDV undertakes to inform the Customer within 96 hours, specifying the exact elements constituting the force majeure, the reasonably foreseeable period of delay or impediment.
CMDV will then be exonerated from any liability due to the non-execution or the delay in the execution of its obligations. In such a case of force majeure, CMDV may exercise its discretionary right to terminate the order or part of it, without its liability being incurred, except however that CMDV will be responsible for reimbursing the Customer for sums already paid.
ARTICLE 22 - MODIFICATION
CMDV reserves the right to modify these General Conditions of Sale at any time.
The Customer will be informed of these modifications by any useful means 30 days before their entry into force.
The Customer who does not accept the modified General Conditions of Sale must not use the Site and access the Product offers to place an order.
Any Customer who uses the Product offers after the entry into force of the modified General Conditions is deemed to have accepted these modifications.
ARTICLE 23 - DISPUTE - ATTRIBUTION OF JURISDICTION - APPLICABLE LAW
These General Terms and Conditions of Sale and the resulting transactions are governed by and subject to French law.
The language of this contract is French, translated into English for international users.
These conditions of sale are subject to French law. In the event of a dispute, the French courts will have sole jurisdiction. In the event of a dispute over the validity, interpretation and/or execution of these general conditions of sale, the parties agree that the courts of Paris will have exclusive jurisdiction to judge, unless there are mandatory rules of procedure to the contrary.
In accordance with the provisions of the Consumer Code relating to the "consumer dispute mediation process", the Customer has the right, with a view to the amicable resolution of a dispute arising from the contract and opposing it to CMDV, to have recourse free of charge and under the conditions set by said code, to a consumer mediator.
In accordance with ordinance n°2015-1033 of August 20, 2015 and implementing decree n°2015-1382 of October 30, 2015, any dispute or consumer dispute subject to article L.612-2 of the Code of consumption, can be settled amicably.
In accordance with Articles L.616-1 and R.616-1 of the Consumer Code, CMDV has set up a consumer mediation system.
The chosen mediation entity is: CMAP - Center for Mediation and Arbitration of Paris.
In the event of a dispute, the Customer may file their complaint on the CMAP website: www.cmap.fr in the tab "you are: a consumer" or by post by writing to: CMAP - Médiation Consumption, 39 avenue Franklin D. Roosevelt, 75008 Paris, France.
The Customer's request must contain his postal address, his e-mail address and his telephone number as well as the surname, first name and address of CMDV, a clear statement of the facts and proof of the previous steps taken with CMDV, so that this request is processed quickly.
All disputes relating to the content, interpretation, validity or execution of these General Conditions of Sale and which cannot be settled amicably will be the exclusive jurisdiction of the courts of the city of the registered office. of CMDV, regardless of the Customer's head office or residence.
ARTICLE 24 - LANGUAGE OF THE CONTRACT AND TRANSLATION
The language of the contract is French.
These General Conditions of Sale have been translated from French to English. The Customer agrees that the original text in French shall prevail in the event of a dispute.
